CDPR won't use generative AI in The Witcher 4 There are potential legal disputes

In January 2024, CDPR said that AI can help improve certain processes in game production, but cannot replace humans. This is an vague statement and it is difficult to determine its true position.However, in the 2024 fiscal report, co-CEO Michał Nowakowski made a specific explanation of the topic, saying that CDPR did not use generative AI in The Witcher 4 and other new works, not because AI is unreliable, but because of potential legal disputes.

“I think we mentioned before that last year we set up a team that is investigating the possibility of using AI in future products, including developing our own customized AI models,” Nowakowski said in his answer to a question about using generative AI in future games of CDPR. “We are working on several research projects, but the focus of these projects is not necessarily generative AI.”

“To be honest, generative AI faces tough problems in many aspects such as legal intellectual property. So when it comes to using generative AI in actual games, we have not made any progress in The Witcher 4 or any recent project.”

CDPR isn't the first company to back down due to legal issues surrounding generative AI: For example, Getty banned users from uploading and selling AI-generated images in 2022, and Valve rejected a game featuring AI-generating art on Steam in 2023.

Using AI in The Witcher 4, Cyberpunk 2078, or CDPR's future works is not entirely impossible, and if copyright issues are resolved, "we might consider it," Nowakowski said.
